Enjoybyte / Legal
Terms of
Use.
Last updated: October 9, 2026
These Terms of Use ("Terms") are an agreement between you and Enjoybyte ("we", "us", "our") governing your use of our mobile games Food Merge 3D: Snack Madness and Penguin Slide: Endless Run (each a "Game", together the "Games"). Enjoybyte is the trading name of Vladislav Medvedev, an individual developer based in Poland, who publishes the Games.
By tapping Accept on first launch, or by playing a Game, you agree to these Terms for that Game. If you do not agree, do not play the Game and remove it from your device.
Everything below applies to both Games unless a paragraph names one of them.
1. Who may play
You must be at least 13 years old to play. If you are between 13 and the age of majority where you live, you may only play, and may only make purchases, with the involvement of a parent or guardian who agrees to these Terms on your behalf.
The Games are not directed to children under 13. See our Privacy Policy for what this means in practice.
2. Your licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and play the Games on devices you own or control, for your own non-commercial entertainment.
This is a licence, not a sale. We keep ownership of the Games.
3. What you may not do
You agree not to:
- reverse engineer, decompile or disassemble a Game, except where the law expressly allows it despite this restriction;
- modify a Game, its files or its saved data to gain an advantage, or use cheats, bots, automation or memory editors;
- obtain paid items without paying for them, or interfere with the purchase or advertising systems;
- connect to, probe or interfere with any interface a Game exposes on your device, other than by playing it normally;
- copy, distribute, sell, rent, sublicense or publicly perform a Game or any part of it;
- remove or obscure any copyright, trademark or other proprietary notice;
- use a Game in any way that breaks the law or the rules of the app store you obtained it from.
We may suspend or end your licence if you do any of these.
4. Coins, skins, purchases and ads
The Games contain virtual currency ("coins") and virtual items such as skins, trails, tables and worlds.
- Coins and items are a licence to use a feature inside the Game. They are not your property and have no monetary value.
- They cannot be exchanged for money, goods or anything of value outside the Game, and cannot be moved from one Game to the other.
- They cannot be transferred, sold or traded to another person.
- We may change, rebalance, add, remove or expire coins and items that you earned by playing or by watching ads, at any time as part of normal game balancing, without compensating you. What applies to items you paid for is set out below.
In-app purchases (Penguin Slide only)
Food Merge 3D contains no in-app purchases. Penguin Slide lets you buy optional items for real money: character skins, packs that bundle several items and may include coins, and No Ads. You can play and finish everything in the Game without buying anything.
- Who you pay. Purchases are made through the Apple App Store and charged to your Apple Account under Apple's own terms. The price, including any taxes, is shown in your currency before you confirm. All purchases are one-off; there are no subscriptions.
- What you get. Items are unlocked in the Game as soon as the payment is confirmed. Skins and No Ads are permanent unlocks tied to your Apple Account. Coins that come with a pack are added once and are used up when you spend them.
- No Ads removes the full-screen ads shown when you leave a run. Video ads that you choose to watch for a reward remain available, because they are optional.
- Restoring. On a new device or after a reinstall, tap Restore Purchases in Settings while signed in to the same Apple Account. Permanent unlocks come back; coins are not added a second time.
- Refunds. Apple handles payments, so refunds are requested from and decided by Apple at reportaproblem.apple.com. We cannot issue a refund ourselves, but write to us if a purchase did not arrive and we will help. If a purchase is refunded or charged back, we may remove what it unlocked.
- Right of withdrawal. Purchases are digital content delivered immediately at your request. Where the law gives you a period in which to withdraw from such a purchase, that right is exercised through Apple and may end once delivery has begun with your agreement. Nothing in these Terms limits the rights that consumer law gives you where you live, including your rights if a paid item is faulty.
- Paid items and changes. We will not take away a permanent unlock you paid for while the Game is available, other than for a breach of these Terms, a refund, or where the law requires it. We may still adjust how an item looks or behaves as part of updating the Game.
Your progress
Food Merge 3D keeps your progress, coins and items only on your device. If you uninstall the Game, clear its data, lose or replace your device, your progress and everything in it are gone permanently. There is no cloud save and no way for us to restore them.
Penguin Slide also saves your progress to your own iCloud when iCloud is switched on for the Game, and brings it back on your other devices. That copy belongs to your Apple Account; we cannot see or restore it. If iCloud is off or unavailable, progress exists only on the device and can be lost in the same way. Paid unlocks can always be restored as described above.
Ads and rewards for watching ads
The Games are free and are paid for by ads from Google AdMob and Unity Ads: video ads you can choose to watch for a reward, and occasional full-screen ads — between levels in Food Merge 3D, and when you leave a run in Penguin Slide. How ads use your information is explained in our Privacy Policy.
- Watching a rewarded ad is always optional.
- The reward is granted only when the ad is watched to the end. If you close it early, or it fails to load or play, no reward is given.
- Ads are not always available. How often they are offered depends on the ad network, your connection and your region, and we may change or limit ad placements at any time.
- Rewards received for ads are virtual items as described above and have no monetary value.
- Ads are provided by third parties. We do not control their content and are not responsible for the products or services they promote.
5. Updates and availability
We may update the Games, change their features, or stop supporting them entirely. We may also stop distributing them. If we decide to withdraw a Game that sells in-app purchases, we will try to announce it on this website at least 30 days in advance.
We do not promise that the Games will always be available, uninterrupted or error-free. Some features require an internet connection and will not work without one.
6. Our intellectual property
The Games and everything in them — code, art, models, music, sound, text, the names Food Merge 3D: Snack Madness and Penguin Slide: Endless Run, and the Enjoybyte name and logo — belong to us or our licensors, and are protected by copyright, trademark and other laws.
Nothing in these Terms transfers any of those rights to you.
You may capture and share screenshots and video of your own gameplay, including monetised videos and streams, as long as you do not claim a Game as your own work and do not use our name or logo in a way that suggests we endorse you.
7. Third-party services
The Games use Google Analytics for Firebase, Firebase Crashlytics, Google AdMob, Unity Ads and the Meta SDK. Penguin Slide also uses Apple's in-app purchase system and iCloud. The Games are distributed through the Apple App Store and, for Food Merge 3D, Google Play. Your use of those services is governed by their own terms and privacy policies. We are not responsible for them.
8. Additional terms for the Apple App Store
If you obtained a Game from the Apple App Store, the following applies and prevails over anything inconsistent in these Terms:
- These Terms are between you and Enjoybyte only, not with Apple. Apple is not responsible for the Game or its contents.
- Your licence to use the Game is limited to Apple devices you own or control, as permitted by the App Store Terms of Service.
- Apple has no obligation to provide maintenance or support for the Game.
- If the Game fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price, if any. To the maximum extent permitted by law, Apple has no other warranty obligation.
- Apple is not responsible for addressing any claim by you or a third party relating to the Game, including product liability claims, claims that the Game fails to conform to legal requirements, and claims under consumer protection or similar legislation.
- Apple is not responsible for investigating, defending, settling or discharging any third-party claim that the Game infringes intellectual property rights.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
9. Disclaimer of warranties
The Games are provided "as is" and "as available", without warranty of any kind. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title and non-infringement.
We do not warrant that the Games will meet your expectations, that they will run without interruption or error, or that defects will be corrected.
Some jurisdictions do not allow the exclusion of implied warranties, so parts of this section may not apply to you. Nothing here limits any statutory consumer rights you have that cannot be waived, including the legal guarantee of conformity for digital content you paid for.
10. Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, lost data or lost progress, arising out of or relating to the Games — even if we were told such damages were possible.
Our total liability for all claims relating to a Game will not exceed the greater of the amount you paid for that Game and for purchases in it in the twelve months before the claim, or ten US dollars (USD 10).
Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for intentional damage, or for anything else that cannot lawfully be limited.
11. Indemnity
You agree to indemnify and hold harmless Enjoybyte from any claim, loss, liability and expense, including reasonable legal fees, arising from your breach of these Terms or your misuse of the Games. This section does not apply to you if you are a consumer and the law where you live does not allow it.
12. Termination
Your licence ends automatically if you breach these Terms, and you may end it at any time by uninstalling the Game.
If your licence ends because of your breach, you are not entitled to a refund for purchases already made, except where the law requires one.
Sections 4 (in respect of the nature of virtual items), 6, 9, 10, 11 and 14 survive termination.
13. Changes to these Terms
We may revise these Terms. When we do, we will update the "Last updated" date and, where the change is material, the Game will ask you to accept the revised version on next launch.
If you do not accept revised Terms, stop using the Game. Paid unlocks you already own remain yours under the version you accepted.
14. Governing law and disputes
These Terms are governed by the laws of Poland, without regard to its conflict of law rules. Any dispute will be resolved in the courts of Poland.
If you are a consumer resident in the European Union, the United Kingdom, or another jurisdiction whose law grants you the right to bring proceedings in your own country, nothing in this section removes that right, and you keep the protection of mandatory consumer law where you live.
15. Our website
These Terms also cover your use of enjoybyte.netlify.app, the site you are reading now.
Everything on the site — text, artwork, logos and game information — belongs to us or our partners, and you may view it for personal, non-commercial use. Our games are works in progress: names, features, release dates and screenshots may change as development continues. Please do not copy, modify, redistribute or present our materials as your own without written permission.
We enjoy hearing from players and fellow creators. When you write to us, keep messages respectful and do not send confidential or unlawful material. We aim to keep the site useful and up to date, but we cannot guarantee that every page or feature will always be available.
16. General
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Games.
Severability. If any provision is found unenforceable, the rest stays in force.
No waiver. If we do not enforce a provision, that is not a waiver of our right to enforce it later.
Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition or sale of assets.
